1. Acceptance of Terms<\/b><\/span><\/h2>

By booking, requesting, or using transportation services arranged by BlueSky Transway Inc. (\u201cCompany\u201d), the customer (\u201cPassenger\u201d) agrees to be bound by these Terms & Conditions.<\/p>

2. Nature of Service<\/b><\/span><\/h2>

BlueSky Transway Inc. operates as a\u00a0<\/span>transportation coordination and dispatch platform<\/b>.<\/span><\/p>

  • Transportation services are\u00a0<\/span>provided by independent third-party drivers or transportation providers (\u201cService Providers\u201d)<\/b><\/b><\/p><\/li>

  • The Company\u00a0<\/span>does not directly provide transportation services<\/b><\/p><\/li><\/ul>

    3. Independent Contractor Relationship<\/b><\/span><\/h2>

    Passenger acknowledges and agrees:<\/p>

    • All drivers are\u00a0independent contractors<\/b><\/span>, not employees of the Company<\/p><\/li>

    • The Company does not control the manner or method of driving services<\/p><\/li>

    • The Company is not responsible for the direct actions of drivers<\/p><\/li><\/ul>

      4. Service Responsibility<\/b><\/span><\/h2>

      The Service Provider (driver) is solely responsible for:<\/p>

      • Operation of the vehicle<\/p><\/li>

      • Passenger safety during the trip<\/p><\/li>

      • Compliance with all applicable laws<\/p><\/li><\/ul>

        5. Limitation of Liability<\/b><\/span><\/h2>

        To the fullest extent permitted by law, BlueSky Transway Inc. shall not be liable for:<\/p>

        • Personal injury or death<\/p><\/li>

        • Property damage<\/p><\/li>

        • Delays, missed flights, or scheduling issues<\/p><\/li>

        • Driver conduct or negligence<\/p><\/li>

        • Accidents or incidents occurring during transportation<\/p><\/li><\/ul>

          6. Insurance & Claims<\/b><\/span><\/h2>

          Passenger agrees:<\/p>

          • Any claims arising from transportation services shall be\u00a0<\/span>directed to the Service Provider and\/or their insurance carrier<\/b><\/b><\/p><\/li>

          • The Company is not the primary liable party for transportation-related claims<\/p><\/li><\/ul>

            7. Booking & Payment Terms<\/b><\/span><\/h2>

            • Pricing is based on distance, time, service type, and other applicable factors<\/p><\/li>

            • Payment may be made via approved methods (e.g., card, Zelle, cash where applicable)<\/p><\/li>

            • All charges must be paid in full unless otherwise agreed<\/p><\/li><\/ul>

              8. Cancellation & No-Show Policy<\/b><\/span><\/h2>

              • Cancellation policies may vary depending on service type<\/p><\/li>

              • Late cancellations or no-shows may result in full or partial charges<\/p><\/li>

              • Specific cancellation rules will be communicated at booking<\/p><\/li><\/ul>

                9. Passenger Conduct<\/b><\/span><\/h2>

                Passengers agree to:<\/p>

                • Behave respectfully toward drivers<\/p><\/li>

                • Not engage in illegal or unsafe conduct<\/p><\/li>

                • Follow reasonable safety instructions<\/p><\/li><\/ul>

                  The driver may terminate the service if passenger behavior poses a risk.<\/p>

                  10. Lost & Found<\/b><\/span><\/h2>

                  • Drivers will make reasonable efforts to return lost items<\/p><\/li>

                  • The Company is not responsible for lost, stolen, or damaged items<\/p><\/li><\/ul>

                    11. Delays & Force Majeure<\/b><\/span><\/h2>

                    The Company is not responsible for delays caused by:<\/p>

                    • Traffic conditions<\/p><\/li>

                    • Weather<\/p><\/li>

                    • Airport operations<\/p><\/li>

                    • Mechanical issues<\/p><\/li>

                    • Events beyond reasonable control<\/p><\/li><\/ul>

                      12. Privacy & Data Use<\/b><\/span><\/h2>

                      Passenger information will be used for:<\/p>

                      • Booking and service coordination<\/p><\/li>

                      • Communication related to the trip<\/p><\/li><\/ul>

                        The Company will not sell personal information but may share necessary details with Service Providers.<\/p>

                        13. Dispute Resolution<\/b><\/span><\/h2>

                        Governing Law<\/b><\/span><\/h3>

                        These Terms shall be governed by the laws of the\u00a0State of California<\/b><\/span>.<\/p>

                        Venue<\/b><\/span><\/h3>

                        All disputes shall be resolved in courts located in\u00a0California<\/b><\/span>.<\/p>

                        Optional Arbitration<\/b><\/span><\/h3>

                        At the Company\u2019s discretion, disputes may be resolved through binding arbitration.<\/p>

                        14. Limitation of Claims<\/b><\/span><\/h2>

                        Passenger agrees:<\/p>

                        • Any claim must be filed within\u00a01 year<\/b><\/span>\u00a0of the service date<\/p><\/li>

                        • Failure to do so constitutes waiver of the claim<\/p><\/li><\/ul>

                          15. Entire Agreement<\/b><\/span><\/h2>

                          These Terms constitute the entire agreement between Passenger and BlueSky Transway Inc.<\/p>

                          16. Acknowledgment<\/b><\/span><\/h2>

                          By booking or using services, Passenger confirms:<\/p>

                          • They have read and understood these Terms<\/p><\/li>
