Customer Terms & Conditions

1. Acceptance of Terms

By booking, requesting, or using transportation services arranged by BlueSky Transway Inc. (“Company”), the customer (“Passenger”) agrees to be bound by these Terms & Conditions.


2. Nature of Service

BlueSky Transway Inc. operates as a transportation coordination and dispatch platform.

  • Transportation services are provided by independent third-party drivers or transportation providers (“Service Providers”)

  • The Company does not directly provide transportation services


3. Independent Contractor Relationship

Passenger acknowledges and agrees:

  • All drivers are independent contractors, not employees of the Company

  • The Company does not control the manner or method of driving services

  • The Company is not responsible for the direct actions of drivers


4. Service Responsibility

The Service Provider (driver) is solely responsible for:

  • Operation of the vehicle

  • Passenger safety during the trip

  • Compliance with all applicable laws


5. Limitation of Liability

To the fullest extent permitted by law, BlueSky Transway Inc. shall not be liable for:

  • Personal injury or death

  • Property damage

  • Delays, missed flights, or scheduling issues

  • Driver conduct or negligence

  • Accidents or incidents occurring during transportation


6. Insurance & Claims

Passenger agrees:

  • Any claims arising from transportation services shall be directed to the Service Provider and/or their insurance carrier

  • The Company is not the primary liable party for transportation-related claims


7. Booking & Payment Terms

  • Pricing is based on distance, time, service type, and other applicable factors

  • Payment may be made via approved methods (e.g., card, Zelle, cash where applicable)

  • All charges must be paid in full unless otherwise agreed


8. Cancellation & No-Show Policy

  • Cancellation policies may vary depending on service type

  • Late cancellations or no-shows may result in full or partial charges

  • Specific cancellation rules will be communicated at booking


9. Passenger Conduct

Passengers agree to:

  • Behave respectfully toward drivers

  • Not engage in illegal or unsafe conduct

  • Follow reasonable safety instructions

The driver may terminate the service if passenger behavior poses a risk.


10. Lost & Found

  • Drivers will make reasonable efforts to return lost items

  • The Company is not responsible for lost, stolen, or damaged items


11. Delays & Force Majeure

The Company is not responsible for delays caused by:

  • Traffic conditions

  • Weather

  • Airport operations

  • Mechanical issues

  • Events beyond reasonable control


12. Privacy & Data Use

Passenger information will be used for:

  • Booking and service coordination

  • Communication related to the trip

The Company will not sell personal information but may share necessary details with Service Providers.


13. Dispute Resolution

Governing Law

These Terms shall be governed by the laws of the State of California.

Venue

All disputes shall be resolved in courts located in California.

Optional Arbitration

At the Company’s discretion, disputes may be resolved through binding arbitration.


14. Limitation of Claims

Passenger agrees:

  • Any claim must be filed within 1 year of the service date

  • Failure to do so constitutes waiver of the claim


15. Entire Agreement

These Terms constitute the entire agreement between Passenger and BlueSky Transway Inc.


16. Acknowledgment

By booking or using services, Passenger confirms:

  • They have read and understood these Terms

  • They agree to all conditions stated herein
